Acceptance of Terms

By accessing or using the Max2Blend service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Max2Blend is operated by Real3D ("Company," "we," "us," or "our"), a company registered in France. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Real3D.

By creating an account, uploading files, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

Section 2

Service Description

Max2Blend provides a cloud-based file conversion service that transforms Autodesk 3ds Max files (.max) into Blender-compatible files (.blend). The Service processes files on our servers and delivers converted output for download.

The conversion process involves parsing 3ds Max scene data including geometry, materials, textures, lighting, cameras, and animation data, and reconstructing equivalent representations in the Blender format.

Important: Due to fundamental differences between the 3ds Max and Blender file formats, engines, and feature sets, we do not guarantee 100% fidelity in all conversions. Complex materials, proprietary plugins, and certain advanced features may not convert perfectly in every scenario.

User Accounts

To use the Service, you must create an account using one of the following methods:

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must provide accurate and complete information when creating your account. We reserve the right to suspend or terminate accounts that contain inaccurate or misleading information.

You agree to use the Service only for its intended purpose of 3D file conversion. You shall not:

Conversion Quality

Max2Blend provides best-effort conversion between the 3ds Max and Blender file formats. While we strive for the highest possible fidelity, you acknowledge and agree that:

We make no warranty, express or implied, that every conversion will produce a perfect reproduction of the original scene. The Service is provided on an "as is" and "as available" basis with respect to conversion quality.

Payment Terms

Max2Blend offers the following payment models:

Pay-Per-Conversion

Individual conversions may be purchased on a per-file basis. Pricing is determined by file size, scene complexity, and selected conversion options. The exact price is displayed before you confirm each conversion.

Subscription Plans

Monthly or annual subscription plans are available, offering a set number of conversions per billing period along with additional features such as extended file retention, priority processing, and batch conversion support.

Refund Policy

Payments are generally non-refundable. However, refunds may be issued in the following circumstances:

Section 8

Intellectual Property

You retain full ownership of and all intellectual property rights in any files you upload to or receive from the Service. Max2Blend claims no ownership, license, or rights over your content.

By uploading files, you grant us a limited, temporary license to process your files solely for the purpose of performing the requested conversion. This license terminates immediately upon completion of the conversion and deletion of the files.

The Service itself, including its conversion engine, algorithms, user interface, documentation, and branding, is the intellectual property of Real3D and is protected by applicable copyright, trademark, and other intellectual property laws.

Section 9

Limitation of Liability

To the maximum extent permitted by applicable law:

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or willful misconduct.

Section 10

Data Retention

Uploaded files (both source .max files and converted .blend files) are retained on our servers for the duration of your configured retention period. The default retention period is 30 days from the date of upload.

After the retention period expires, files are permanently deleted from all of our systems, including any temporary processing caches and backups. This deletion is irreversible.

You are responsible for downloading your converted files before the retention period expires. We strongly recommend downloading converted files promptly after conversion completes.

Section 11

Termination

Either party may terminate this agreement at any time:

Upon termination, any outstanding subscription fees for the remainder of the current billing period are non-refundable unless the termination is due to our material breach of these Terms.

Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Governing Law) shall survive any termination or expiration of these Terms.

Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice before the updated Terms take effect. Notice may be provided via:

Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and terminate your account.

Non-material changes (such as typographical corrections or clarifications that do not alter the substance of the Terms) may be made without advance notice.

Section 13

Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of laws principles.

Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France. Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.

If you are a consumer located in the European Union, you also retain the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.
